TERMS AND CONDITIONS


ARTICLE 1 : PRELIMINARY INFORMATION


The descriptive sheets on the Site are intended to inform buyers, prior to the placing of their order, the content of the proposed services relating to transportation and stay, the price and terms of payment, the conditions of cancellation and modification travel. The purchase of tours proposed by Changez d’Éire entails the full adhesion of the buyer to the present general conditions of sale and the unconditional acceptance of all their provisions. By making a reservation with Changez d’Éire, you agree to be bound to these Terms of Sale for yourself and for all persons named in the reservation, including minors and people with reduced mobility.
Guests requiring special assistance must notify Changez d’Éire at the time of booking and must be accompanied by a qualified person. The Company is not liable for any refusal to provide a service from a carrier, hotel, restaurant or other independent supplier, or any expenses incurred.
Due to space restrictions, passengers wishing to bring wheelchairs, oxygen cylinders, walkers or other devices must first apply in writing. Changez d’Éire reserves the right to make changes to the information on the Site. They will be applicable as soon as they are posted. The tours are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred regarding this presentation, Changez d’Éire shall not be held responsible.

ARTICLE 2 : OBJECT


These terms and conditions are intended to define the rights and obligations of the parties in the context of the sale of holidays offered by Changez d’Éire to the buyer. They are also affected by these conditions of sale, the offers presented on the site www.changezdeire.com.
The general conditions of sale applicable are those in effect at the date of validation of the order placed by the buyer.

ARTICLE 3 : REGISTRATION & ORDER


3.1 Registration for a tour on changezdeire.com
Anyone purchasing a tour must be over 18 years old, must have an email, phone, mailing address and a means of payment, in the form of a credit card.
3.1.1 Purchase of a gift voucher
3.1.1.1 Create a gift voucher
The process of creating a gift voucher is as follows: The buyer fills in the information requested of him
- Name of the buyer;
- Name of the beneficiary;
- Message possibly desired;
- You can choose the desired amount;
- You can also choose a trip already registered at Changez d'Éire;
- A special service within the framework of a stay already booked at Changez d'Éire among the following services: a dinner, a themed activity, a guide, a night in a hotel.
You must take note of the present general conditions of sale and accept them by clicking in the indicated place.
You must then pay for his order by bank transfer.
The order then binds the buyer who cannot cancel the contract. The buyer then receives an electronic confirmation of his order.
3.1.1.2 Using a gift voucher
Gift certificates are valid for a period of one year from the date of purchase. They are cumulative and can be used for the payment of all or part of the offers marketed by Changez d’Éire.
In case of loss or theft of a gift voucher by the buyer, it can not in any case engage the responsibility of Changez d’Éire. Once the gift voucher has been purchased, it cannot be exchanged or cancelled.
3.2 Order a tour by email
The buyer will place their order by completing a form on the Site. After completing the form, the buyer is contacted, by phone or email, by Cathy for the preparation of their trip.
Please note that after two refusals of quotation from you, a €25 search fee will be charged to you, for each additional estimate (all charges based on that day’s rate of exchange). Note that you will have to pay this fee before receiving the new quote. The buyer then receives by email an invoice summarizing the details of his order and price, these terms and conditions of sale in PDF format. The buyer must be aware of the contractual conditions applicable to his order.
The buyer will then confirm their order by returning the dated and signed invoice with the mention "I declare to have read the general conditions of sale and special conditions before ordering and accept them without reservation" by email. The buyer must then pay an advance payment in accordance with the provisions of Article 4 of these conditions within 8 days. The buyer then receives an email confirmation of his order within 24 hours from the receipt of the invoice and the deposit.
3.2.1 Modification of the initial order
Any request for modification of a reservation made on the internet or by telephone may be made. A new invoice with additional fees will be sent by email to the buyer for validation. The buyer will take back the initial order, search fee (if applicable), its reference, and / or optional additional services through Changez d’Éire (supplement single room, on classification, etc.).
The buyer must confirm the modification of his order by returning the new invoice dated and signed with the mention "I declare to have read the general conditions of sale and special conditions before placing an order and have accepted without reservation" by email to : cathy@changezdeire.com
Once the deposit is paid, no further changes can be made.

ARTICLE 4 : PAYMENT


4.1 Means of payment
4.1.1 Accepted means of payment for orders made on the site changezdeire.com
To pay for your order, the buyer has the following payment method:
- secure online payment by credit card (Visa Debit & Credit, MasterCard Debit & Credit, and Maestro)
- Lydia app- mobile payment;
A non refundable deposit of 25% of the price of the tour is requested at the time of booking and to confirm it.
The balance, 75% of the price of the tour must be paid no later than 60 days before departure. If your booking is less than 60 days, the full payment will be requested.
4.2 Payment security
The buyer guarantees to Changez d’Éire that they have the necessary authorization to use the mode of payment chosen, during the validation of the order. Changez d’Éire reserves the right to suspend any running order in case of refusal of authorization for payment by credit card from the officially accredited bodies or in case of non-payment. Changez d’Éire reserves the right to refuse to honour an order from a buyer who has not fully paid or a previous order or with whom a payment dispute is being administered. Changez d’Éire has implemented an order verification procedure to ensure that no one uses the bank details of another person without his/her knowledge. As part of this verification, the buyer may be asked to send by email to Changez d’Éire a copy of a piece of identification and a proof of address. In this case, the order will be validated only after receipt and verification by Changez d’Éire parts sent.
4.3 Payment of the balance of the order
For all orders made by credit card, the remaining balance of the order will be automatically charged:
The remaining 75% of the trip price will be automatically charged 60 days prior to departure.
When the order is placed less than 60 days before departure, the balance will be automatically collected within 24 to 48 hours following the order.
4.4 Absence of payment of the balance
In the absence of payment of the balance within the above time, Changez d’Éire will not be required to maintain the availability of the trip which is considered cancelled by the customer. In this case Changez d’Éire will reserve the right to retain an amount corresponding to the cancellation compensation provided for in Article 9 of these conditions.
4.5 Proof of the transaction
The computerized records, preserved in the computer systems of changezdeire.com under considerable conditions of safety, will be regarded as the proofs of the communications, the orders and the payments made between the parties. The filing of purchase orders and invoices is done on a reliable and durable support that can be produced as evidence

ARTICLE 5 : ABSENCE OF RIGHT OF WITHDRAWAL


The buyer of tourist products does not benefit from the withdrawal period to which he is entitled when he remotely purchases other products or services.
5.1 The price of the trip includes:
All prices quoted are per person, in Euros (€). Travel and holiday information Changez d’Éire mention notes what is included in the price and what is not. Unless otherwise stated in the trip description, the price of the trip does not include:
- Any supplement (s) of personal type, sea and air transport, airport taxes, car rental, fuel, tolls, parking. Meals other than breakfast, drinks, entrances to tourist attractions, tour prices, gratuities, equipment rentals, or tourist tax. Repatriation assistance / insurance is also not included.
- All booked accommodations are 2 or 3 stars; they are prepaid and reserved for you.
- All rooms are equipped with bathroom and toilet and have breakfast included.
5.2 Car Rental
Changez d’Éire does not take care of the car reservation and will not be responsible for the rental contract or the car. The following are the responsibility of the buyer:
- Optional insurance.
- Abandonment fees to another rental agency.
- Payment and fine management fees generated during the rental.
- All other supplements specific to each renter and contracted on site.
Age requirement of the driver:
Various age restrictions apply depending on the renters and the categories of vehicles offered. As a general rule, the minimum age is 25 for most categories of cars (or 23 for categories 1, 2 and 3 for an additional charge); the maximum age is 75 (or more with a certificate).
Drivers under 25, i.e. drivers aged 21, 22, 23 or 24 are subject to an insurance surcharge of up to 25 Euro per day and drivers 70 or over are subject to an insurance surcharge of up to 25 Euro per day. Every driver must hold a valid driver's license for at least 24 months, sometimes longer depending on the rental company. Supplements may apply for anyone unable to meet this specificity. As the main driver, one must also be able to present a credit card in his/her name.
On-Site Assistance Services:
All car rentals include a 24/7 assistance service. The phone numbers of assistance will be clearly indicated on the documents delivered by the renter. For any linguistic, technical or practical questions Changez d’Éire also offers a helpdesk.
Deductible in case of accident:
From € 1000, the latter applies depending on the category of vehicle chosen, and according to each renter, in case of incident or accident caused by you or a third party.
Please note: If you do not opt for deductible purchase with the renter when picking up the vehicle, the renter will not be able to let you leave with the vehicle reserved. You will then have to agree to financially guarantee your total ability to pay the deductible by accepting an imprint only, or by debiting your credit card by the renter, depending on their procedure.
Depending on the type of credit card you use, you may benefit from a "buy-back" protection. Voluntarily triggering this insurance implies that you have checked the special clauses stipulated in your credit card agreement & insurance covers included, and that you correctly fulfill the contract presented by the renter upon your arrival. In all cases the renter will take a deposit on your credit card. In case of accident / incident, the renter will debit your credit card the deductible amount, but the latter will be credited shortly by the insurance agency linked to your credit card used for rental. Be mindful to pay for your tour (including car rental) with the same credit card. Also be sure to name the cardholder as a driver, unless there are multiple people covered by this card.
Warning: It is impossible to rent a vehicle without presenting an international credit card. Each renter has special conditions; it is important that you check your own banking arrangements before you go to find out your insurance cover for renting a vehicle abroad.
All rental companies accept credit cards and, in general, no special conditions in relation to the insurance covered by your cards. In all cases, the credit card, presented at the counter of the rental agency, to cover a full tank of gas and additional options, must be in the name of the driver (or main driver) to finalize the lease. Our support services can be contacted at any time for any translation or additional advice.
Please note: For the advance of full fuel, all the rental companies take a fixed financial guarantee (Deposit) directly from your bank card when taking the vehicle. If you receive a ticket, try to pay it immediately in the city it was given. Failure to pay this ticket means that the car rental company will receive a correspondence to which it must respond. This administrative cost will be automatically debited on your credit card (about €35), but not the amount of the ticket (always check your statement). In this case you will have to directly pay the payment of your ticket to the civil service (County Council) of the locality concerned.
Petrol /diesel: Note that each petrol station does not systematically present its fuels in the same way. Before refuelling, be sure to use what you need to use. Each renter usually displays the type of fuel required near the fuel cap, sometimes on your dashboard and in any case on your lease. Take time at the pump and make sure you make the right choice. This will save you calling support services, losing valuable travel time and accumulating both the cost of fuel lost, new fuel tank, eventual towing service and especially tank cleaning - an average cost of €400 or more.
Petrol is: Unleaded Petrol - Diesel is: Diesel.
Warning: Some renters charge for services that others do not offer. We strongly recommend that you pay close attention to the options that you will validate with the renter upon your arrival. It is your responsibility to verify the content of what you validate. Once your contract is signed, and the additional services validated with the renter, you will not be able to intervene. Some rental companies may apply a limited mileage for a short-term rental of 1 to 3 days. Otherwise the mileage is unlimited.
If you notice a bad condition of the vehicle when picking up the vehicle at the car rental agency, (a bald tire, a scratch, a dent, etc.), point it out immediately to the renter. AFTER THIS, IT WILL BE TOO LATE.
In the case of damage (s) to a vehicle, you must:
- * In the event of an accident with another vehicle:
- Use the services of Police (Garda), Fire Brigade and/or Hospital in priority according to extent of the accident.
- Contact assistance if the vehicle needs to be towed. These support numbers will be clearly marked on your confirmation document.
- Do not sign anything with the other party beforehand.
- Complete an accident report (slip attached to your contract and documents in your vehicle).
- Fill in an Accident Report.
- Keep the contact information of the Police (Garda) officer if present.
- The expenses related to the assistance service will be covered by the renter.
- Depending on who is responsible, the renter will decide whether or not to rent a vehicle.
- * In the event of damage to the vehicle resulting in its immobilisation:
- Contact assistance.
- Fill in an Accident Report when returning the vehicle to the car rental agency.
- The expenses related to the service of assistance will be covered by the hirer (according to determination or not of your responsibility). A replacement vehicle of the same or higher category will be provided as a replacement, if your vehicle can not be repaired immediately.
- * In case of damage to the vehicle, but not resulting in its immobilization:
In case of a tire problem (the damage waiver does not cover the tires - except for a private renter), try to do your own tire exchange and repair if you want to save time, or contact the service centre for assistance. They will come to assist you and possibly tow the vehicle to the nearest garage (be careful, according to the renter, you will be charged for this service).
- Fill in an Accident Report when returning the vehicle to the car rental agency.
Warning: Do not make repairs without contacting us before to ask for advice. In all cases of damage(s) caused to the vehicle with return of the vehicle to the car rental agency by you, allow enough time to fill in the necessary documents and formalities with the car rental company (Accident Report).
5.3 Accommodation
All accommodation used in our "Tours" section are based on 2 or 3 star hotels.
All accommodations are reserved under your name. Identification must be presented at arrival.
- All rooms are equipped with bathroom and toilet.
- Breakfast included.
All accommodations, regardless of their category, provide towels. Wash cloths very rarely. Toiletries are always available in hotel and guest houses, occasionally at private homes (soap, shower gel, shampoo).
Telephone, television, radio alarm clock, iron, hairdryer, coffee services are generally available in hotels; they are occasionally available in other types of accommodation (or on request).
Warning: Upon possible request of accommodation providers, and in the case of tariff reductions related to the ages of children, you agree to have and present the identification of the children travelling under your responsibility.
5.4 Fishing benefits: wearing a lifejacket
It should be noted that for all fishing (by boat, lake fishing or fishing at sea), the wearing of a lifejacket is mandatory in Ireland.
Changez d’Éire stipulates to its contracted service providers to provide this equipment for any boat trip booked by them, on the basis of a vest for each fisherman or accompanying person. It is the responsibility of each user to ensure that the lifejacket is offered to him and then to wear it. Changez d’Éire cannot be held responsible for non-compliance with these security conditions.

ARTICLE 6 : PRICE REVISION


The price announced in € Euros, at the time of order and payment, is the definitive price. As any availability must be verified during the booking request, Changez d’Éire cannot be held responsible in case of non-availability related to the time taken to confirm the reservation request or rate increase due to the unavailability of benefits discussed first.
No stay can be guaranteed unless you pay at least 25% of the total cost of the tour/stay. The final booking of the services can only be confirmed once the deposit has been received. Changez d’Éire cannot refund or exchange unused accommodations, services or other activities.

ARTICLE 7 : INSURANCE


No medical repatriation insurance or assistance is included in the tours offered for sale by Changez d’Éire.
We strongly advise you to take out optional insurance with a third party insurance company.
3 types of insurance will usually be offered:
- Travel cancellation insurance only.
- Assistance insurance - repatriation / medical expenses / baggage
- Cancellation insurance - repatriation assistance / medical expenses / baggage
In case of cancellation, insurance premiums, registration fees, Visa fees will not be reimbursed by Changez d’Éire.

ARTICLE 8 : ADMINISTRATIVE AND HEALTH FORMALITIES


8.1 Identity Card, Visa or Passport
The documents to be produced depend systematically on your nationality. EU citizens can travel to Ireland with a simple ID card. Other travellers will need to know the law in force for their country to know if they need to present a passport, or a Visa.
Please check that each participant in the trip (for children and infants, please inquire at your city or region) has a valid identity card and/or passport for the duration of the stay.
8.2 Customs and borders: transport of alcohol and tobacco
Nationals of EU countries do not need to make a customs declaration when they enter Ireland. You can transport and consume tobacco and alcohol products for your personal use, but not for resale. You do not have to prove that the goods are for your personal use if you carry less than:
800 cigarettes (200 per plane *)
400 cigarillos (100 per plane *)
200 cigars (50 per plane *)
1 kg of tobacco (250 g of smoking tobacco *)
10 litres of spirits (1 per plane *)
20 litres of fortified wine (2 per plane *)
90 litres of wine (of which a maximum of 60 litres of sparkling wine) - (4 per plane *)
110 litres of beer (16 per plane *)
These rules do not apply to travellers under the age of 18, who are not allowed to carry alcohol or tobacco in any quantity.
* Indicative limits for air transport. Please check with the airline.
8.3 Health
The buyer is advised to apply for health insurance with their local health insurance company. It will save you from having to deal with a possible medical consultation. Some are free and are accepted by many doctors in Ireland.

It is also recommended to obtain health insurance and repatriation.

ARTICLE 9 : MODIFICATION AND CANCELLATION


9.1 Modification or cancellation by the buyer
9.1.1 Modification of the order
It is important to note that once the deposit paid by the buyer a reservation change fee is incurred. These fees are assessed according to the stage of preparation of the file. A minimum of €50 is applicable. The interruption of the tour by the buyer cannot be refunded by Changez d’Éire.
9.1.2 Cancellation of the order
Whenever possible, Changez d’Éire limits the cancellation fee to the maximum. However, Changez d’Éire is obliged to cover its administrative costs and, if applicable, the cancellation fees invoiced by various service providers with whom it works.
Any cancellation from the buyer entails the collection of the following fees:
- 61 days before the date of departure: 25% on the total price of the trip (deposit).
- From 60 days before departure: 100% of the total price of the stay.
9.1.3 Assignment of contract
The buyer may transfer his reservation to a person who fulfills all the requirements for the trip. The transferor must inform Changez d’Éire of his/her decision by any means to obtain an acknowledgment of receipt no later than 30 days before the start date of the trip or stay by indicating precisely the name(s) and address of the transferee(s) and the travel participant(s) and that they fulfill the same conditions as them to make the journey.
The assignment entails an additional minimum application fee of €50 per person. The transferor and the assignee who takes back the order are jointly liable for the payment of the balance of the price of the trip and any additional costs caused by this transfer.
9.2 MODIFICATION OR CANCELLATION BY CHANGEZ D’ÉIRE
9.2.1 Modification by Changez d’Éire before departure
When, before the departure of the buyer, an external event imposing on Changez d’Éire forces him to modify an essential element of the contract concluded with the customer (dates of the tour, significant increase of the prices, changes of route), Changez d’Éire will notify the buyer by any means as quickly as possible by proposing either a change of travel or a trip substitution.
If the price of the modified service is less than the initial price, the remaining balance must be calculated and, if the buyer has already paid in full, the overpayment will be refunded before departure.
9.2.2 Change due to Changez d’Éire after departure
When, after the departure of the buyer, Changez d’Éire is unable to provide an important part of the services provided for in the contract representing a significant percentage of the price honoured by the buyer, Changez d’Éire must immediately make the following arrangements without prejudge remedies for damages for any damage suffered:
Either offer services to replace the planned benefits, possibly supporting any additional price and, if the services accepted by the buyer are of inferior quality, Changez d’Éire must reimburse the buyer, on his/her return, the difference in price;
Or, if Changez d’Éire cannot offer any replacement services or if they are refused by the buyer for valid reasons, provide the buyer, at no extra cost, tickets to ensure his/her return in conditions may be deemed equivalent to the place of departure or to another place agreed between Changez d’Éire and the buyer.
9.2.3 Cancellation due to Changez d’Éire before departure
When, before the departure of the buyer, Changez d’Éire must cancel the trip or tour, it will inform the buyer by any means to obtain an acknowledgment of receipt. If the parties do not reach the conclusion of an amicable agreement on a trip or a substitute stay, Changez d’Éire will pay the buyer the immediate refund, without penalty of the sums paid.
These provisions do not apply in the cases referred to in article 9 of these Terms and Conditions.

ARTICLE 10 : LIABILITY


Changez d’Éire acts as a creator and organizer of travels. In this role, it selects various service providers and works as an agent for coach, car, accommodation and other service provider companies.
Changez d’Éire is responsible as of right with regard to the buyer of the good performance of the obligations resulting from the contract.
Changez d’Éire cannot be held responsible for the non-performance or the bad execution of the contract attributable either to the customer, because of the circumstances of the inevitable, or because of a third party foreign to the service provided for in the contract.
Changez d’Éire cannot be held responsible for changes to schedules or itineraries, delays, changes caused by circumstances beyond its control.
Changez d’Éire is not responsible for flights and losses committed during the tour.
Changez d'Éire will be in no way responsible for any damage committed during the stay by the buyer or any persons accompanying and should be reported as soon as possible to Changez d'Éire.
Changez d’Éire cannot be held responsible for the consequences of the following events:
- Loss or theft of airline tickets.
- Default of presentation or presentation of documents of identity and / or sanitary expired or of an insufficient duration of validity (identity card, passport, visas, certificate of vaccination, etc.) or not in conformity with the prescribed formalities.
- In the event of failure to register (including for late boarding), 100% of the total amount of the trip will be retained.
- Incidents or unforeseeable and insurmountable events of foreign unites such as: wars, political troubles, strikes outside of Changez d’Éire’s control, technical incidents external to Changez d’Éire, airspace crowding, bankruptcy of a provider, bad weather delays (including delays in courier services for the transmission of tickets), breakdowns, loss or theft of luggage or other effects. The delay(s) suffered as a result of the cases referred to above as well as any itinerary modifications that may result from it may not result in any compensation whatsoever, in particular as a result of the modification of the duration of the program initially planned or delay to a flight connection. Any additional costs related to a disruption (tax, hotel, parking, etc.) will remain the responsibility of the customer.
- Cancellation imposed by inevitable circumstances and/or for reasons related to the safety of customers and/or the order of an administrative authority, Changez d’Éire reserves the right to change the dates, times or itineraries provided if it considers that the safety of the traveller cannot be ensured, without the latter being able to claim any compensation.

ARTICLE 11 : PROCEDURES BEFORE AND AFTER YOUR STAY


Changez d’Éire does not deal with the purchase of air tickets or boat and will not be responsible for any disputes with their companies.
You will have to arrange your own pre and post delivery services to the point of departure from Ireland and to your place of residence upon your return from the trip. We will help you if needed, either by phone or email. We can also make the reservation for you, after agreement on your part.
Your banking information will then be required to make this reservation.
Changez d’ Éire will not refund the services booked, the costs incurred, in case of occurrence of a case of force majeure, an unforeseeable and insurmountable event of a third party or the fact of the traveller who would modify the services initially subscribed.

ARTICLE 12 : CUSTOMER SERVICE - CLAIMS & DISPUTES


12.1 Prior complaint
All complaints regarding tours offered on the Site or the functioning of the Site must be sent by email as soon as possible to the following address : cathy@changezdeire.com
In case of disputes, you will have 7 working days, starting from the date of your departure from Ireland to make your claim.

ARTICLE 13 : PRIVACY POLICY (PERSONAL DATA)


13.1 Scope
Changez d’Éire is committed to respecting your privacy and treating your data confidentially.
Changez d’Éire collects personal data in connection with the consultation of its Site and the orders placed in it in compliance with the data protection regulations ("Data Protection Acts" of 1988 and 2002).
This Privacy Policy describes how Changez d’Éire processes and uses your personal information when you visit the Site.
By visiting the Site, you agree to the terms of this Privacy Policy.
This privacy policy does not apply to websites that are not related to this privacy policy or that are provided by third-party publishers. Changez d’Éire is in no way responsible for the content of other websites and their privacy policy.
This privacy policy must be read in conjunction with the terms of use of the site and the Terms and Conditions of Changez d’Éire.
Changez d’Éire reserves the right to modify this privacy policy, in particular to comply with changes in the legislation relating to the protection of personal data and respect for privacy.

Changez d’Éire can collect from your personal data:
This is the data that identify you or can be used to identify you or contact you, such as:
- Your name,
- Your first name,
- Your postal address,
- Your email,
- The IP addresses of your computers when they have not been deleted, abbreviated or made anonymous,
- Your phone number,
- Your date of birth,
- Billing and payment information such as your credit card number.
This information is collected only if you voluntarily communicate it to Changez d’Éire.

ARTICLE 14 : APPLICABLE LAW


These Terms and Conditions are subject to the application of Irish law. The parties undertake to seek an amicable solution to any dispute that may arise from the interpretation or execution of the Contract. Any dispute arising from the interpretation, execution, non-performance, or consequences, or consequence of these Terms and Conditions may be submitted to mediation, prior to any legal action. In case of refusal of mediation or failure of mediation, the parties will submit the dispute to the competent courts of the Republic of Ireland.
